Last updated: June 2025 1. Acceptance of Terms By accessing or using Blinko Philippines ("Blinko.ph," "the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. These terms govern your use of Blinko.ph and all related services. 2. The Blinko.ph Marketplace Blinko.ph is an online marketplace that connects buyers (pet owners) with independent sellers of pet products. Blinko.ph is not a retailer. We do not own, store, or ship any products listed on the platform. All transactions are directly between buyers and sellers. Blinko.ph facilitates these transactions by providing the platform, payment infrastructure (where applicable), and trust and safety services. 3. User Accounts To use Blinko.ph as a buyer or seller, you must be at least 18 years of age or have parental consent, provide accurate and complete registration information, maintain the confidentiality of your account credentials, and notify us immediately of any unauthorised use of your account. You are responsible for all activity that occurs under your account. 4. Buyer Terms Orders placed on Blinko.ph constitute a binding purchase agreement with the seller. You agree to provide accurate delivery information for each order. Blinko.ph is not responsible for delays or issues arising from incorrect delivery information. Orders may only be cancelled while in Pending status, before the seller confirms. Payment terms (e.g., cash on delivery) are agreed between you and the seller. 5. Seller Terms As an approved seller on Blinko.ph, you agree to list only products that are legal, accurately described, and safe for animals; fulfill confirmed orders promptly and communicate delivery timelines to buyers; maintain accurate stock quantities to prevent overselling; pay Blinko.ph's commission of 10% on each completed sale; not engage in fee circumvention; respond to buyer inquiries and order updates in a timely manner; and comply with all applicable Philippine laws. 6. Prohibited Items and Conduct The following are strictly prohibited on Blinko.ph: products not related to pets or animals; counterfeit, stolen, or illegally obtained goods; products that violate Philippine wildlife protection laws; false or misleading product descriptions or images; harassment, fraud, or abuse of buyers, sellers, or Blinko.ph staff; and any activity that violates applicable Philippine laws. 7. Intellectual Property The Blinko.ph name, logo, and platform design are the intellectual property of Blinko Philippines. Sellers retain ownership of their product photos and descriptions but grant Blinko.ph a non-exclusive license to display this content on the platform for the purpose of operating the marketplace. 8. Limitation of Liability Blinko.ph is a marketplace facilitator and is not liable for the quality, safety, legality, or delivery of any product sold by a seller on the platform. To the maximum extent permitted by applicable law, Blinko.ph's total liability to any user shall not exceed the amount of commission collected by Blinko.ph on the relevant transaction. 9. Account Suspension and Termination Blinko.ph reserves the right to suspend or terminate any account that violates these Terms of Service, engages in fraudulent activity, or harms other users of the platform. Sellers whose accounts are suspended for violations forfeit any pending commissions owed. 10. Governing Law These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms or your use of Blinko.ph shall be subject to the exclusive jurisdiction of the appropriate courts of the Philippines. 11. Changes to Terms Blinko.ph may update these Terms of Service at any time. We will notify registered users of material changes.
